Clear terms for using AuthNTick Identity Services.

These terms explain how customers, applicants and organisation users may access AuthNTick Identity Services for background screening, identity verification, police checking support and related online services in Australia.

These terms are written for general service use and should be read with any product-specific terms, applicant consent forms, privacy notices and Nationally Coordinated Criminal History Check requirements that apply to a particular check.

1. Acceptance

Using the service means you accept these terms.

These Terms of Service form an agreement between you and AuthNTick Identity Services. By accessing our website, creating an account, submitting a check, accepting an invitation, paying for a service or continuing to use the platform, you agree to follow these terms.

If you use the service for an organisation, you confirm that you are authorised to accept these terms for that organisation and to manage checks on its behalf.

If you do not agree with these terms, you must not use the website, platform or related services.

2. Services

What AuthNTick Identity Services provides.

AuthNTick Identity Services provides online tools and support for background screening, identity verification, police checking, right-to-work checks, reference checks, qualification checks and related services.

Some services rely on third-party data sources, accredited bodies, government agencies, education providers, employers, referees or technology vendors. We coordinate the workflow and provide the service available to us, but we do not control every external response time, source record or external decision.

Where a Nationally Coordinated Criminal History Check or other regulated check is requested, you must also comply with the applicable consent, identity, eligibility and use requirements for that check.

3. Accounts

You are responsible for account access and correct use.

You must provide accurate account information, keep your login details secure and notify us promptly if you suspect unauthorised access. You must not share access in a way that avoids user controls, audit trails or permissions.

Organisation administrators are responsible for inviting appropriate users, removing users who no longer require access and ensuring that internal users only access information for legitimate business purposes.

  • Do not impersonate another person or organisation.
  • Do not submit false, misleading or incomplete information.
  • Do not interfere with the operation, security or integrity of the platform.
  • Do not attempt to access records that you are not authorised to view.

4. Applicant information

Applicants must be informed and checks must be authorised.

Before requesting a check for an applicant, you must have a lawful basis to do so and must ensure the applicant receives the required notices and gives any required consent. Applicant information must be complete, current and submitted for the correct check type and purpose.

Applicants are responsible for providing accurate personal details, identity documents and supporting information. A delayed, incomplete or rejected check may result if required information is missing, inconsistent or cannot be verified.

Check results must only be used for the purpose disclosed to the applicant and only by people who are authorised to handle that information.

5. Fees and payments

Fees are payable when a service is ordered.

Fees, package inclusions and billing arrangements are shown at the point of order, in your organisation agreement or in a written quote. Unless we state otherwise, amounts are in Australian dollars and may include GST where applicable.

You must ensure that payment details are accurate and that you are authorised to use the selected payment method. We may use third-party payment processors to handle payments securely.

Because many checks involve external processing once submitted, refunds may not be available after a check has started or after external fees have been incurred. Nothing in these terms excludes rights you may have under the Australian Consumer Law.

6. Privacy and security

Personal information must be handled carefully.

AuthNTick Identity Services handles personal information in accordance with its privacy notices and applicable Australian privacy requirements. You must also handle applicant information, check status information and check results securely and only for authorised purposes.

You must not transfer, publish, sell, disclose or reuse personal information or check results except as permitted by law, by the applicant's consent, by the relevant product requirements or by a written agreement with AuthNTick Identity Services.

If you become aware of an actual or suspected privacy, security or data handling incident involving our services, you must notify us promptly and cooperate with reasonable investigation, containment and notification steps.

7. Screening limits

Results are point-in-time and depend on source information.

A check result reflects the information available from relevant sources at the time the check is processed. It is not a guarantee of a person's future conduct, character, suitability, immigration status, employment performance or ongoing eligibility.

Employers and organisations must make their own suitability, hiring, onboarding and risk decisions. You should consider the role, legal obligations, internal policies, procedural fairness and any applicant response before making a decision based on screening information.

Where a fresh check is required because time has passed, the role has changed or a law or policy requires it, a new application may need to be submitted.

8. Customer obligations

Customers must use the services lawfully and fairly.

You are responsible for deciding which check is appropriate, ensuring that the requested check is connected to a genuine purpose and using results in a lawful, fair and proportionate way.

  • Comply with employment, privacy, anti-discrimination and record keeping laws.
  • Give applicants required notices and a reasonable opportunity to respond where required.
  • Limit access to results to personnel with a genuine need to know.
  • Store and dispose of records securely and in line with your legal obligations.
  • Do not resell, repackage or provide checks to third parties unless expressly authorised.

9. Availability

We aim to keep the platform reliable.

We may perform maintenance, release updates or suspend access where needed to protect the platform, comply with law, respond to misuse or address security, technical or operational issues.

We may also suspend or close an account if we reasonably believe these terms have been breached, information has been misused, payment is overdue or continued access creates a compliance, security or legal risk.

10. Liability

Important limits apply to the service.

To the extent permitted by law, AuthNTick Identity Services is not liable for indirect loss, loss of profit, loss of opportunity, reputational loss or consequential loss arising from use of the website, platform or services.

Our liability is not excluded or limited where it cannot lawfully be excluded or limited, including under the Australian Consumer Law. Where the law allows us to limit a remedy, our liability may be limited to supplying the service again or paying the cost of having the service supplied again.

11. Changes

Terms and services may change over time.

We may update these terms to reflect changes to our services, laws, regulator requirements, security practices, payment arrangements or platform features. The updated terms apply from the date they are published unless a later date is stated.

If a change is material and you have an active account, we may provide additional notice through the platform, by email or through another reasonable channel. Continued use after the effective date means you accept the updated terms.

12. Governing law

Australian law applies.

These terms are governed by the laws of New South Wales, Australia, unless a mandatory law requires another jurisdiction. The parties submit to the courts with jurisdiction in New South Wales and any courts that may hear appeals from those courts.

If any part of these terms is invalid or unenforceable, that part is read down or removed to the extent required, and the rest of the terms continue to operate.

13. Definitions

Words used in these terms.

Applicant
A person for whom a check, verification or screening service is requested.
Customer
A person or organisation that orders, pays for, manages or receives access to a service.
Platform
The AuthNTick website, dashboard, applicant workflow, APIs, support channels and related systems.
Personal information
Information or an opinion about an identified person, or a person who is reasonably identifiable, including identity and screening information.
Services
Background screening, identity verification, police checking support, right-to-work checks and related services provided through AuthNTick Identity Services.
